  1. About This Privacy Policy

This Privacy Policy describes how exquise.com (the “Site” or “we” or “Exquise” or “Company”) collects, uses, and discloses your Personal Information when you visit or make a purchase from the Site.

When you visit or use our websites, apps and other services, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support. In this Privacy Policy, we refer to any information that can uniquely identify an individual (including the information below) as “Personal Information”. When we use the term “personal information” in this Privacy Notice, we mean information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to an individual or household. You may choose not to submit the requested information, but that may limit or prohibit the services that Exquise is able to provide to you.

  1. Information We Collect

We collect information about you in three ways: directly from your input, third parties and through automated technologies.

2.1 Data You Provide to Us 

The types of personal information that we collect directly from you depends on how you interact with us and the Service, which may include:

  • Contact details, such as your name, email address, postal address, zip code, social media handle, and phone number;
  • Account login credentials, such as usernames and passwords, password hints and similar security information;
  • Payment information, such as a credit or debit card number;
  • Information about your use of our services and store it in your profile, such as your orders, and similar activity
  • Comments, feedback and other information you provide to us, including search query data and questions or information you send to customer support; and/or
  • Interests and communication preferences, including preferred language.

2.2 Data from Other Sources

We also may obtain contact details and other information about you from our affiliates and from other third parties, including:

  • Social networks when you grant permission to the Service to access your data on one or more networks;
  • Service providers that help us determine a location in order to customize certain products to your location;
  • Businesses with which we offer co-branded services or engage in joint marketing activities; and/or
  • Publicly available sources and data suppliers from which we obtain data to validate or supplement the information we hold.

2.3 Data from Use of Service, Cookies 

The Service may automatically collect information about how you and your device interact with the Service, including:

  • Computer, device and connection information, such as IP address, browser type and version, operating system and other software installed on your device, mobile platform and unique device identifier and other technical identifiers, error reports and performance data;
  • Usage data, such as the features you used, the settings you selected, your URL click stream data, including date and time stamp and referring and exit pages, search terms you used, and pages you visited or searched for on the Service;
  • For location-aware Services, the region, city or town where your device is located to provide you with more relevant content for where you are in the world.

We collect this data through our servers and the use of cookies and other technologies. Cookies are small text files that can be read by a web server in the domain that put the cookie on your hard drive. We may use cookies and other technologies to store your preferences and settings, help you with signing in, provide targeted ads and analyze site operations. You can control cookies through your browser’s settings and other tools.   1. How We Use Your information

Depending on how you interact with us and the Service, we use your personal information to:

  • Provide, activate and manage your access to and use of the Service;
  • Process and fulfill a request, order, download, subscription or other transaction;
  • Provide technical, product and other support and to help keep the Service working, safe and secure;
  • Enhance and improve the Service and our other products, events, and services and to develop new products, services and benefits;
  • Offer you customized content and other personalization to make the Service more relevant to your interests and geography;
  • Respond to your requests, inquiries, comments and concerns;
  • Notify you about changes, updates and other announcements related to the Service and our other products and services;
  • Deliver targeted advertisements, promotional messages, notices and other information related to the Service and your interests;
  • Provide you with promotional messages and other information about products, events and services of ours, our affiliates and third parties such as sponsors;
  • Invite you to participate in user testing and surveys as well as drawings, sweepstakes and similar promotions;
  • Identify usage trends and develop data analysis, including for purposes of research, audit, reporting and other business operations, including determining the effectiveness of our promotional campaigns and evaluating our business performance, or in other ways pursuant to a customer agreement; and/or
  • Comply with our legal obligations, resolve disputes, and enforce our agreements.
  1. Sharing of Your Information

4.1 Our Group Companies and Service Providers

Dependent upon the Services provided, we share information with:

  • Our affiliates, trading names and divisions within Exquise Group worldwide and certain companies that provide technology, customer service and other shared services functions; and/or
  • Our service providers, suppliers, agents and representatives, including but not limited to, payment processors, customer support, email service providers, event venues and service providers, IT service providers, marketing service providers, research providers, mailing houses, sponsors and shipping agents;
  • to process the information as necessary to provide the Service, complete a transaction or fulfill your request or otherwise on our behalf based on our instructions and in compliance with this privacy policy and any other appropriate confidentiality and security measures.

4.2 Our Use of Your Sensitive Personal Information

 

The following personal information elements we collect may be classified as “sensitive” under the U.S. state privacy laws (“sensitive information”):

 

Username and password;

Credit and debit card number plus expiration date and security codes (CVV) (“payment card information”).

As described in our Privacy Policy, we use username and password to remember you and facilitate your transactions on the services.

 

Please note that for transaction online, we use third party payment processors, who collect and process payment card information on our behalf. As such, we do not collect or retain any payment card information in connection with transactions other than tokenized information or the last four digits of your card for our records. For transactions conducted over the phone with our Customer Support Center, we will collect payment card information and directly forward it to our payment processor and do not retain the payment card information other than tokenized information or the last four digits of your card for our records.

4.3 For Legal Reasons

We also will disclose your personal information if we have a good faith belief that such disclosure is necessary to:

  • meet any applicable law, regulation, legal process or other legal obligation;
  • detect, investigate and help prevent security, fraud or technical issues; and/or
  • protect the rights, property or safety of Exquise, our users, employees or others; and
  • as part of a corporate transaction, such as a transfer of assets to or an acquisition by or merger with another company.
  1. Grounds for Processing

When we collect or otherwise process any personal information within the scope of applicable data protection laws, we do so, to the extend required or necessary:

  • to provide the Service, fulfill a transaction or an order, or otherwise perform a contract with you or at your request prior to entering into a contract;
  • for our compliance with applicable law or other legal obligation;
  • for the performance of a task carried out in the public interest;
  • to enable our customers to comply with their legal obligations;
  • to operate our business, protect the security of our systems, customers and users, detect or prevent fraud, or fulfill our other legitimate interests as described in sections 2-4 above, except where our interests are overridden by your privacy rights.

Where we rely on your consent to process personal information, you have the right to withdraw your consent at any time, and where we rely on legitimate interests, you may have the right to object to our processing.

 

  1. Data Retention

We retain your personal information for as long as necessary to provide the Service and fulfill the transactions you have requested, or for other essential purposes such as complying with our legal obligations, maintaining business and financial records, resolving disputes, maintaining security, detecting and preventing fraud and abuse, and enforcing our agreements. If you access the Service through a subscription administered or sponsored by your organization, we retain your organizational contact details after the termination of your organization’s subscription to continue to communicate with you.

 

  1. Data Security

We implement technical and organizational measures to seek to ensure a level of security appropriate to the risk to the personal information we process. These measures are aimed at ensuring the integrity, confidentiality, and availability of personal information.

 

  1. Children’s Privacy

We do not knowingly collect information from children under the age of 14 or target the Service to children under 14.

 

  1. Your Communications Preferences

You can customize and manage your communications preferences and other settings when you register with the Service, by updating your account features and preferences, by using the "opt-out" mechanisms such as "unsubscribe" or other means provided within the communications that you receive, or by contacting us. We reserve the right to notify you of changes or updates to the Service whenever necessary.

10.1 Your Account

The Service may allow registered users to directly access and review their account information and make corrections or updates upon login at any time. Keeping such information up to date is the responsibility of the user. Registered users may also close their account directly through the Service or by contacting the Service’s customer support.

10.2 Your Rights

You may have the right under applicable privacy and data protection laws to request free of charge:

  • access to your personal information;
  • rectification or erasure of your personal information;
  • restriction of our processing of your personal information, or to object to our processing; and
  • portability of your personal information.

In particular, depending on your state of residency and subject to certain legal limitations and exceptions, you may be able to exercise some or all of the following rights:

The Right to Know

The right to confirm whether we are processing personal information about you and, under California law only, to obtain certain personalized details about the personal information we have collected about you, including:

  • The categories of personal information collected;
  • The categories of sources of the personal information;
  • The purposes for which the personal information were collected;
  • The categories of personal information disclosed to third parties (if any), and the categories of recipients to whom this personal information were disclosed;
  • The categories of personal information sold (if any), and the categories of third parties to whom the personal information were sold; and
  • The categories of personal information shared for targeted advertising purposes (if any), and the categories of recipients to whom the personal information were disclosed for these purposes.

The Right to Access & Portability

The right to obtain access to the personal information we have collected about you and, where required by law, the right to obtain a copy of the personal information in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another entity without hindrance.

The right to correct inaccuracies in your personal information, taking into account the nature of the personal information and the purposes of the processing of the personal information

The Right to Control Over Automated Decision-Making / Profiling

The right to direct us not to use automated decision-making or profiling for certain purposes, including any form of automated processing of personal information to evaluate, analyze, or predict personal aspects concerning an individual’s economic situation, health, personal preferences, interests, reliability, behavior, location or movements in furtherance of decisions producing legal or similarly significant effects

Right to Opt-Out of Sales or Sharing of Personal information

The right to direct us not to (a) “sell” your personal information to third parties for monetary or other valuable consideration, or (b) “share” your personal information with third parties for cross-context behavioral advertising purposes and targeted advertising purposes.

The Right to Request Deletion

The right to request the deletion of personal information that we maintain about you, subject to certain exceptions.

Depending on your state of residency, you may also have the right to not receive retaliatory or discriminatory treatment in connection with a request to exercise the above rights. However, the exercise of the rights described above may result in a different price, rate or quality level of product or service where that difference is reasonably related to the impact the right has on our relationship or is otherwise permitted by law.

  1. Do Not Sell or Share My Personal Information

Sell. Under the laws of California, Colorado, Connecticut and Utah, the definition of “sale” is broad and covers many common business activities, even when the personal information used is not exchanged for money, or when it has been partially de-identified. Exquise may share personal identifiers, or internet, network and device information, and preferences and inferences for data analytics including fraud detection, marketing and advertising purposes, for example, to better understand consumer engagement with our brand, to match your interests with similar products you may also be interested in, to offer advertising for our products across other devices that you use, and to identify other consumers with interests similar to yours who may also be interested in our products.

 

Under Virginia law, “selling” is the exchange of your Personal Information for monetary consideration only. Exquise does not sell your personal information for money to third parties for their independent business use.

 

Share. When we use the term “share” or “sharing” we mean sharing, renting, releasing disclosing, disseminating making available, transferring or otherwise communicating orally, in writing, or by electronic or other means, your personal information by us to a third-party for cross-context behavioral advertising as well as targeted advertising as defined under the U.S. state privacy laws.

We do “share” sensitive information.

Additional privacy terms may be applicable depending on your location. These region-specific notices are mostly incorporated into, and should be read in conjunction with, this Privacy Policy. Residents of the U.S. states of California, Virginia, Colorado, Connecticut, and Utah who have interacted with us in the ways described in this Privacy Policy have certain privacy rights granted under the applicable laws in their state (respectively, the California Consumer Privacy Act of 2018 as amended by the California Privacy Rights Act, the Virginia Consumer Data Protection Act, the Colorado Privacy Act, the Connecticut Data Privacy Act, the Utah Consumer Privacy Act, and any similarly constructed U.S. state law enacted in the future; collectively, the “U.S. state privacy laws”).You may reach us at shop@exquise.com to request a copy of our region specific notice policy.

California Residents

Retention of Personal Information. We retain personal information only for as long as is reasonably necessary to fulfil the purpose for which it was collected. However, if necessary, we may retain personal information for longer periods of time, until set retention periods and deadlines expire, for instance where we are required to do so in accordance with legal, tax and accounting requirements set by a legislature, regulator or other government authority.

To determine the appropriate duration of the retention of personal information, we consider the amount, nature and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of personal information and if we can attain our objectives by other means, as well as our legal, regulatory, tax, accounting and other applicable obligations.

Therefore, we retain personal information for as long as the individual continues to use our services for the purposes explained in the Information We Collect and Use section of our Privacy Policy. In particular, we will retain their personal information for as long as necessary to comply with our legal obligations, to resolve disputes and defend claims, as well as, for any additional purpose based on the choices you have made, such as to receive marketing communications. We will retain personal information supplied when joining our services, including complaints, claims and any other personal information supplied during the duration of an individual’s contract with us for the services until the statutory limitation periods have expired, when this is necessary for the establishment, exercise or defense of legal claims.

Nevada Residents

If you are a resident of the State of Nevada in the United States, Chapter 603A of the Nevada Revised Statutes permits a Nevada resident to opt out of potential future sales of certain covered information that a website operator has collected or will collect about the resident.
